• undertakes to implement appropriate security measures to prevent the unauthorised carriage on an aircraft of an explosive or an explosive device.
• undertakes that at the time of consignment:
- cargo will have secure, undamaged packaging.
- the contents of the cargo have not been tampered with.
- the cargo is accompanied by documentation that identifies the Customer as the consignor of the cargo.
- the cargo is presented by a person who can be verified as a representative of the Customer.
• is aware that cargo will be subject to security and clearing procedures.
• is aware that it is illegal without authorisation, to consign as cargo, an explosive or explosive device.
• accept the Import Duties, Taxes and Clearance Charges as laid out below:
In this section, "Customer" means the person or entity booking the shipment with the Company; "Company" means KIS Corporate Pty Ltd; "Carrier" means FedEx or any other carrier engaged to perform the shipment; and "Duties and Charges" means all import duties, taxes (including GST or any equivalent), customs clearance, brokerage, handling, disbursement, administration and recovery charges assessed or levied in connection with the shipment.
Where the Customer elects, requests or agrees — whether by selecting a "duties and taxes to be paid by receiver/third party" option, by the applicable Incoterms, or in any other way — for the Duties and Charges to be borne by the receiver or a nominated third party, the Customer acknowledges and agrees that:
(a) Account number required. The Customer must supply a valid receiver or third-party carrier account number at the time of booking. Supplying the receiver's name or contact details alone is not sufficient and does not guarantee that the Duties and Charges will be billed to, or recovered from, that party.
(b) Customer warranty. The Customer warrants that any account number it supplies is valid, current and authorised for this purpose, and that the receiver or third party has agreed to pay the Duties and Charges. The Company is entitled to rely on this information and is not obliged to verify it.
(c) Reversion of liability. If a valid receiver or third-party account number is not supplied, or if the receiver or third party fails, refuses or is unable to pay the Duties and Charges for any reason (including insolvency, dispute, or rejection or abandonment of the shipment), the Carrier may bill those Duties and Charges to the Company's account, and responsibility for them reverts to the Customer.
(d) Indemnity and reimbursement. The Customer agrees to indemnify and reimburse the Company in full, on demand, for all Duties and Charges billed to or paid by the Company under paragraph (c), together with the Company's reasonable administration and recovery costs — except to the extent any such charge results directly from the Company's own error or negligence. This obligation applies regardless of how long after the shipment the charges are billed, and survives completion and delivery of the shipment.
(e) No control over Carrier billing. The Customer acknowledges that the decision to bill the Company's account rests with the Carrier and is outside the Company's control, and that any allocation of duties between the Customer and the receiver (including under any Incoterms) does not bind the Carrier.
(f) Payment. Amounts payable under this section are due within seven (7) days of the Company's invoice, and may not be withheld or set off. Charges billed by the Carrier in a foreign currency are payable as the equivalent amount in Australian dollars, together with any conversion cost. Amounts are stated exclusive of GST.
